These Terms & Conditions (“Terms”) govern your access to and use of Facesoma (the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The service
Facesoma is an aesthetic facial analysis tool. You upload a photo; we generate a report scoring facial features across ten dimensions, with strengths, areas for improvement, and grooming suggestions. The output is informational and intended for personal use.
2. Not medical, legal, or professional advice
Facesoma is not a medical device, medical service, or substitute for professional advice. The reports we produce are aesthetic assessments generated by a machine-learning model. They do not diagnose, treat, prevent, or cure any condition. They are not designed to inform decisions about surgery, medication, mental health, or any other matter requiring qualified professional judgment. If you are considering aesthetic procedures, consult a licensed practitioner.
3. Eligibility
You must be at least 16 years old to use Facesoma. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms in your jurisdiction.
4. Acceptable use
You agree not to:
- Upload photos of anyone other than yourself unless you have their explicit consent;
- Upload photos of minors;
- Upload content that is unlawful, infringing, harassing, hateful, sexually explicit, or otherwise harmful;
- Use the Service to harass, demean, harm, or shame any person;
- Attempt to reverse-engineer, decompile, or extract the underlying models or training data;
- Use automated means (bots, scrapers, etc.) to interact with the Service except as permitted by a public API agreement;
- Resell, sublicense, or commercially redistribute Facesoma output without written permission;
- Circumvent rate limits, access controls, or security measures.
5. Your content
You retain all rights to the photos you upload. By uploading, you grant Facesoma a limited, non-exclusive, royalty-free license to process the photo for the sole purpose of generating your report. This license terminates the moment the report is generated and your photo is discarded. We claim no other rights to your image.
6. Our content
The Service (including the website, code, models, copy, design, logos, and brand) is owned by Facesoma or its licensors and is protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service except as expressly permitted.
You may freely use, share, and download the report we generate for you, including the PDF export, for personal, non-commercial purposes. The report itself remains subject to these Terms.
7. Subjectivity disclaimer
Beauty is multidimensional and not reducible to a single number. Facesoma's scores reflect statistical patterns in our training data. They are not a verdict on your worth, attractiveness to any specific person, or any other deeply personal quality. Treat the report as one data point among many.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACESOMA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
10. Indemnification
You agree to indemnify and hold harmless Facesoma, its officers, directors, employees, and agents from any claim, demand, damage, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
13. Changes
We may update these Terms from time to time. If we make material changes we'll update the “Last updated” date and, where appropriate, notify users in-app. Continued use of the Service constitutes acceptance.
